The right of motor insurers to seek reimbursement from drivers accused of consuming psychotropic drugs
It was published on 15 July 2024 in the Diário da República (Official Gazette), No. 135, Series I, the Supreme Court of Justice's Uniform Judgment no. 10/2024, dated 23 May, case no. 3489/17.5 T8STR. E1-A, that stipulates that insurers, to exercise their right of recourse after compensating the injured party, must assert and demonstrate that the driver operated the vehicle while impaired by psychotropic substances that diminished his physical and mental capacity for safe driving. This impairment must be substantiated through medical or expert evaluation.
