The Law No. 27/2021, of 17 May, has approved the Portuguese Charter of Human Rights in the Digital Age.
The Charter will enter into force 60 days after its publication.
Overall, the Charter sets forth rights and duties in the digital environment, which cover different areas from the manifestation of personality rights in cyberspace - the right to privacy in a digital environment and the right to identity and other personal rights -, to the manifestation of constitutionally protected rights, freedoms and guarantees in cyberspace – right to free access to the Internet; freedom of expression and creation in a digital environment; rights to assemble, demonstrate, associate and participate in a digital environment; right to the development of digital skills; children's right to special protection – among many other areas.
Protection of personal data and cybersecurity naturally emerge as the main areas addressed in the content of the Charter. Within this scope, the Charter grants a global process of transforming the Internet into an instrument for the achievement of freedom, equality and social justice, with a view to social inclusion in a digital environment, as well as a space for the promotion, protection and free exercise of human rights.
