Regulation No. 310/2020 of the National Data Protection Commission (CNPD) was published in Diário da República on March 31, which provides for the value of fees for assessing and deciding on applications to CNPD.
The product of the fees charged - the amount of which, according to the regulation, must be proportional to the complexity of the order and the service provided - constitute CNPD's revenues, which may be charged for (i) accreditation and certification, (ii) for prior consultation, (iii ) for issuing authorizations and (iv) for examining codes of conduct. The amount of fees is calculated by reference to the value of the unit of account (UC) legally set forth for legal proceedings - the UC is fixed at 102 euros -, taking into account the administrative costs arising from the opening and processing of the procedure and, especially, the complexity the tasks that the analysis of each type of order requires.
